Consumer ALERT: New Variations of Phishing Email Being Sent -- Beware!

The "phishing" industry is morphing their tactics as people are becoming wise to their past methods.  These criminals learn quickly and are becoming more sophisticated in ways to fool you.

I just received the following message from a bank.  I immediately knew that it was bogus, since I did not have an account with it... but as I read the mail, I first started to think that is was legit, just sent to me by mistake. 

I then looked it over more closely... valid return address, valid contact information about the bank, no suspicious links (just plain text), a warning about the dangers of "phishing", low-key suggestion to write a letter, email or call the included phone number.  I thought, "Okay, it appears legitimate," and if I was the average account holder I would probably be seriously considering calling the phone number "immediately" as directed.

After checking the bank's web site (which I located independently, never use the supplied links/addresses as they may be pointing to a fake site), the only difference I noted was that the bank's phone numbers where in XX state and the phone number provided was in Illinois.  (Which did not necessary mean it was fake, as many organizations have support numbers in different locations.)

However, by this time I was certain it was bogus for reasons I don't want to publish here, so out of curiosity I dialed the number included several times in the email, so they obviously were intending to drive responses to it.  

On the phone, I encountered an automatic, official sounding message that said, "Welcome To XXXXX State Bank's Account Reactivation System... to start, please have your credit card information available and press 1 when ready..."

Here is an actual text of the email and actual phone number, the only change I made was to conceal the bank, as it was in no way their fault.  (I did report the incident to them.)

XXXXX State Bank has confirmed that a small number of people were recently phished. "Phishing" is when a criminal replicates a legitimate web site to deceive individuals into providing personal financial, or other confidential information.

An unknown number of people recently received an email that appeared to be sent from XXXXX State Bank. We currently working to shut down the phishing site, and determining the extent to which our clients may have been affected.

Due to this attempts we have had to temporary suspend any future authorizations being conducted with your Credit Card. Please call us immediately at 1-309-807-0946

We will review the activity on your account with you and upon verification, we will remove any restrictions placed on your account. Please disregard this notice if you already re-activate your card.

Warning Drivers: Don't Drink and Drive and Now: Don't Text and Drive In New Jersey

Texting / Text messaging banned in New Jersey (NJ), also cell phone and electronic device messagingStarting March 1, 2008 a new version of New Jersey's law against cell phone usage while driving will go into effect.

It will ban the hand-held use of all cell phone and electronic communication devices (e.g., Blackberry) while driving for talking, text messaging and emailing, except in emergencies. You will still be able to use hands-free and Bluetooth devices.

The new law makes violation of this law a primary offense. Prior to March 1st, New Jersey law made talking on a cell phone a secondary offense -- meaning a driver had to be caught committing a first offense in order to be cited for use of a cell phone. Now you can be stopped specifically for this offense.

A person who violates the no cell phone usage law will be fined $100.

Year-to-Month Residential Past Sales Trends

I was wondering if anyone was noting the market trends in their surrounding counties that I have in my area of South Jersey...

Most counties are experiencing some slowing of the number of homes sold / year from their 2005-06 highs (which I translate to number of buyers, about 15-20%), but the number of homes available for sale have not decreased proportionately.

This appears to have increased the average days on market (up until closing). 

The increase in supply vs. demand usually results in lower prices, but I'm seeing mixed results, ranging from minor average price decreases to little significant change to continued price increases.

I was curious as to what your county-wide experience is and how you interpret the statistics?

New Jersey Developing Overcrowding Legislation Effecting Landlords and Tenants

The following news relase was received from our state Realtor association, updating it's members on the status of a New Jersey state bill that if passed will directly impact landlords and tenants. The question is still, how forceful it will be and in what form?...

On February 14, 2008, the New Jersey Senate Community and Urban Affairs Committee passed S164 - Bucco (R25), Gill (D34) with NJAR® amendments. The bill allows a municipality to impose upon landlords and/or tenants who have violated occupancy requirements an overcrowding fine.

During the last legislative session, NJA® secured amendments excluding seasonal rental units from the bill, as well as amendments stating that tenants can also be fined for violating occupancy requirements, and when tenants would be responsible for an overcrowding violation.

At the committee hearing on February 14, NJAR® also secured an amendment to extend the implementation of the law for six months, in order to allow time to make the updated contracts and rental agreements available to NJAR® members.

The bill now heads to the full Senate.    (Source: NJAR, bold lettering added)


Whether you are a landlord or a tenant you need to follow this legislation closely.  As with all legislation, it has a positive goal to correct overcrowding conditions that effect the health, safety and property of the occupants and the community. However, legislation can also have negative impacts if not thought out carefully and fully, and if implemented improperly.

Another AR member has written a blog article, Fine the Landlord $5,000 for Overcrowded Units in NJ, in which he raises the red flag about what he sees as potential abuses in it's enforcement.

If you are a landlord or tenant, you should read the proposed bill (see link above) carefully to see how it might effect you and make your thoughts known to your state representative.

Consumer Protection: New Jersey Consumer Information Statement (C.I.S.)

One of the first requests that a consumer should expect to receive from a NJ licensed real estate agent is a request to view and sign a New Jersey Consumer Information Statement (in PA it's called a Consumer Notice).

State law in New Jersey requires that all agents present a Consumer Information Statement (CIS) upon first contact with a real estate consumer.  The purpose is to inform and explain to the consumer about the different forms of agency relationship and what real estate office the agent is licensed under and representing.  The real estate codes/statutes are very clear about this requirement as it was established for the protection of the consumer.  Failure on the part of the agent to properly present and obtain confirmation of that presentation will put the agent and his agency in jeopardy of action by the state real estate commission with suspension or even loss of license.
 
While some consumers may be hesitant about signing anything, it is important to realize and be assured that it is not a contract and even says so on the form.  The agent is only doing what he is required to do by the state real estate commission.  

What you do and agree to after signing is what will determine the agency relationship you will have with the agent.

New Jersey Identity Theft Protection

The New Jersey state government is actively developing and implement laws to protect the local individual against identity threats.  Just as with the federal government, the NJ state government is focusing on making it harder to illegally obtain identity information by requiring users and holders of identity information to maintain proper protection procedures.  

New Jersey has passed tougher laws which went into effect during 2006.   It is important that you become aware and more importantly, become compliant with the new information security requirements.

According to New Jersey's Office of Attorney General, the "Identity Theft Prevention Act," which took effect on January 1, 2006, is the most comprehensive and easy-to-use identity theft prevention law in the nation which gives consumers the tools they need to protect their financial well-being.

There are some basic general first steps that can be taken by an individual immediately upon discovering personal information or documents are stolen: "If someone has stolen your personal information or identification documents, you can do several things to prevent the misuse of that information if you act quickly. For financial account information, such as a credit card or bank account, close the accounts immediately. If you believe your Social Security number has been stolen, call the toll-free fraud number for any of the three major credit bureaus and place a fraud alert on your credit reports. Free Tax Help at Vaughn Hall Every Tuesday Until April 15th

The American Association of Retired Persons (AARP), in cooperation with the Internal Revenue Service (IRS), sponsors a FREE income tax counseling service for taxpayers, with special attention to those age 60 and older. 

Trained counselors will be in Vaughan Hall on Medford Lakes-Tabernacle Road at Powhatan Trail, in Medford Lakes every Tuesday morning from February 5, 2008 through April 15, 2008, 9:00AM until noon, to assist taxpayers. 

Appointments are not necessary.  

Counselors can prepare noncomplex federal and New Jersey income tax returns, prepare New Jersey real estate tax rebate forms for 2007, review returns prepared by taxpayers, or consult on specific questions which taxpayers may have. 

Certain counselors can prepare federal and New Jersey income tax returns by computer and file them electronically at no cost.

Meeting Notice: Information Session on Underground Storage Tanks (USTs)

The New Jersey Environmental Commission will be hosting an information session on underground oil tanks on March 11, 2008.

The purpose of this session is to provide information on state grant programs and cover issues related to the cleanup of leaking and non-leaking tanks from professionals in the oil service and remediation, real estate and insurance fields. who will also be on hand to discuss issues and answer questions related to their fields. 

State Grant programs provide reimbursement to homeowners of up to $1,200 for closure/removal of non-leaking underground oil tank and up to $3,000 for closure/removal/replacement of an underground tank.  The reimbursement program also covers costs for removal of tanks retroactive to August 6, 2006.

Underground Storage Tanks In New Jersey

Underground storage tanks (UST) are an issue effecting all counties in New Jersey. The definition of an UST, as set forth in N.J.A.C. 7:14B-1.6: is any one or combination of tanks, as set forth in N.J.A.C. 7:14B-1.4, including appurtenant pipes, lines, fixtures, and other related equipment, used to contain an accumulation of hazardous substances, the volume of which, including the volume of the appurtenant pipes, lines, fixtures and other related equipment, is 10 percent or more beneath the surface of the ground. A 'Tank' is a stationary device designed to contain an accumulation of hazardous substance which is constructed of non-earthen materials (for example, concrete, steel, plastic) that provide structural support.

Resources for Avoiding Prolonged High Exposure to Radon in New Jersey

The EPA recently posted on it's web site updated information discussing the results of two studies showing definitive evidence of an association between residential radon exposure and lung cancer. A North American study and a European study, both combined data from several previous residential studies. These two studies go a step beyond earlier findings. Radon

Radon is a natural radioactive gas that you can't see, smell or taste. Its presence in your home can pose a danger to your family's health. As stated in a previous post, in our region it is highly recommended to test for radon if you have a basement (or have flooring that is below ground level), especially if it is a basement in which you will be spending a lot of time.  Radon tests are relatively inexpensive for the peace of mind they can provide with knowing that your property is not exposing you to unhealthy doses of radon or, if it is high, that now it can be easily remediated.

Technology Issues Benefitting from Technology Progress

Just went through three weeks of system changes, upgrades and trouble shooting on one of my primary web sites.  To top it off, the web hosting provider moved my my site to a new server system with a completely different operating system.

It's been very tiring, but I hope that the effort will make it easier for visitors to access all of the information on my web site.

I was expecting major problems, but other than a few inconvenient "hiccups", it went relatively smoothly.

I have a couple of weeks worth of feature enhancements to put in place and get acclimated.  Hopefully it will continue to proceed as planned. 

I am thankful for the technical support people who are quickly responding to any issues that do arise.

The major networks and systems are gradually becoming more standardized over the years, which allows for easier transitions such as this.  In the past, it would have required a complete rebuild from the bottom up, if it was even possible, to make this major of a transition.  Technological progress does keep moving along.

IRS: Stimulus Rebate Payments In May Require Filing A 2007 Tax Return

The Internal Revenue Service (IRS) advised taxpayers that in most cases they will not have to do anything extra this year to get the economic stimulus payments beginning in May.

"If you are eligible for a payment, all you have to do is file a 2007 tax return and the IRS will do the rest," said Acting IRS Commissioner Linda Stiff.

The IRS will use information on the 2007 tax return filed by the taxpayer to determine eligibility and calculate the amount of the stimulus payments.

The IRS will begin sending taxpayers their payments in early May after the current tax season concludes. Payments to more than 130 million taxpayers will continue over several weeks during the spring and summer. A payment schedule for taxpayers will be announced in the near future.

Stimulus payments will be direct deposited for taxpayers selecting that option when filing their 2007 tax returns. Taxpayers who have already filed with direct deposit won't need to do anything else to receive the stimulus payment. For taxpayers who haven't filed their 2007 returns yet, the IRS reminds them that direct deposit is the fastest way to get both regular refunds and stimulus payments.

Qualifying income includes Social Security benefits, certain Railroad Retirement benefits, certain veterans' benefits and earned income, such as income from wages, salaries, tips and self-employment. While these people may not be normally required to file a tax return because they do not meet the filing requirement, the IRS emphasizes they must file a 2007 return in order to receive a payment.

"Some people receiving Social Security and veterans' benefits may not realize they will need to file a tax return to get the stimulus payment," Stiff said.

Charleston home to be a model for sustainability and green building

HUD Unveils New Concept Home Vision - CharlstonORLANDO, FL - The U.S. Department of Housing and Urban Development unveiled its new vision for a sustainable, hurricane-resistant and energy-efficient home at the National Association of Home Builders' International Trade Show in Orlando. HUD's Partnership for Advancing Technology in Housing (PATH) revealed the design plans for a Concept Home demonstration project to be built in Charleston, South Carolina.

Concept Home Charleston will serve as a model of sustainability, hurricane-resistance, efficient building practices, and floor plan flexibility. The project will incorporate the most advanced products and systems from leading manufacturers to demonstrate and educate both industry and consumers alike how design and technology innovations can create a sustainable, efficient and durable home that's also cost-effective to build and high in quality.   

The Charleston home will be built at Poplar Grove, a 6,000-acre nature conservation community within Greater Charleston's historic Ashley River Preservation District and is expected to be completed by Fall 2008.  (Source: HUD No. 08-015)
